WAGE AND HOUR LAWS
Questions about wage and hour laws continue to challenge and
confuse employers and human resources professionals, even those with
many years of experience. In this half day seminar, Laddey, Clark &
Ryan’s Employment and Labor Practice Group will help human resources
professionals and employers learn how to navigate the sea of state
and federal wage and hour laws with confidence. Join us for a step
by step overview of the law so you can avoid costs and fines from
wage and hour audits and litigation. This interactive seminar will
cover:
- How to properly classify employees as exempt or non-exempt;
- How to properly classify independent contractors under the
Fair Labor Standards Act (“FLSA”);
- How to calculate hours worked and related issues concerning
breaks, non-commuting travel time, preparation for work,
seminars and work related meetings, time on call, and work off
the clock ;
- Minimum wage under federal and state law, exemptions from
the minimum wage under the FLSA;
- How to create a safe harbor from liability for improper
deduction;
- The no-pay docking rule and exceptions to the no-pay
docking rule;
- How to determine if your employee is entitled to
overtime compensation: how to compute overtime; what to do about
unauthorized overtime; regular rate of pay; and exemptions from
overtime under the Fair Labor Standards Act;
- Employer obligations regarding deductions from pay;
- Preparing for a wage and hour audit by the Department
of Labor;
- New legislation: the Lilly Ledbetter Fair Pay Act of
2009: what it says and how it could affect your business.

About Your Presenters
Thomas N. Ryan is the Managing Partner and Chair of the Employment
and Labor Practice Group at Laddey, Clark & Ryan. He is a former
president of the Sussex County Bar Association, a member of the Labor
and Employment Law Section of the New Jersey State Bar Association, a
Master in the prestigious Sydney Reitman Employment Law Inn of Court,
and a former president of the Mountain Lakes Board of Education. He
studied labor relations at Harvard University, where he earned his
Masters degree, and received his law degree from Seton Hall University.
He grasps the intricacies of labor and employment law from the
perspectives of management and labor. That's why he specializes in labor
and employment law as well as civil litigation.
Ana Linda Day is admitted to practice law in New Jersey and in the
New Jersey District of U.S. District Court. She received her
undergraduate degree from Douglass College, Rutgers University and her
law degree from Rutgers School of Law, Newark. After graduation from law
school, Ms. Day served as law clerk to the Hon. William M. D'Annunzio,
then J.S.C. Chancery Division, Somerset County. Ms. Day served on the
Supreme Court of New Jersey District X Ethics Committee and as a
Barrister in The Worral F. Mountain Inn of Court. She is a member of the
New Jersey Bar Association, the Sussex County Bar Association and the
Sidney Reitman Labor and Employment Law Inn of Court.
