TRIAL DATE SET IN SPARTA WOMAN’S CASE AGAINST
BMW NORTH AMERICA

Sparta, NJ --- A local resident will have her day in court as she goes head to head with the North American distributor of the BMW X5 for its unsafe and faulty seat heaters.

27 year-old Sparta resident Jen Macones sustained 2nd degree burns to her upper thigh and buttocks, after sitting down on her heated seats in her BMW X5. Her burns have forced her to undergo extensive and continuing treatment to minimize the resulting scars. The seat heater apparently malfunctioned, burning through the seat cushion, seat cover and then burning her skin. It is a permanent injury which will not go away without surgical intervention.

The Trial date has been set for April 13, 2009, at which time Macones will not only ask for damages to compensate her for her injuries, but also for punitive damages -- since she claims BMW did nothing to protect consumers from being injured.

"Through investigation we have learned that BMW had received a number of complaints from customers of the X5 that their seat heaters malfunctioned prior to Ms. Macones’ injury,” says Lauren McFadden Esq., attorney with Laddey Clark & Ryan representing Macones. “However, BMW did nothing to notify its customers that there might be a problem with their seats, and they still refuse to take responsibility for what their faulty seat heater did to Ms. Macones."
